Code of Conduct

GameSpark strives to offer a fair, fun and safe environment for all players. This Code of Conduct is intended to provide our players with examples of behavior that may fall outside of GameSpark community standards. Please note that this Code of Conduct is incorporated into and forms part of our Terms of Service which you must agree to before using our Services.

Improper behaviors that fall outside of GameSpark community standards include, but not limited to:

1. Improper Gameplay.

   • Playing the game in violation of our Terms of Service and/or any local laws or regulations.
   • Creating false personas, including impersonating or pretending to be a moderator, administrator or another person.

2. Improper Communication, whether created through Services or through third party devices connected to Services.

   • Posting material that infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy.
   • Posting material that is fraudulent, false, misleading or deceptive.
   • Posting material that is defamatory, obscene, pornographic, voyeuristic, sexually explicit, vulgar or offensive, or depicts or promotes sexual violence or deviant sexual behavior (including incest, paedophilia, bestiality and necrophilia). We have zero-tolerance on child sexual abuse material (CSAM) and will report any CSAM content detected by us or reported to us to the relevant authorities.
   • Posting material that promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group, or which glorifies, incites or endorses ethnic, racial or religious hatred, strife or intolerance.
   • Posting material that is violent or threatening or promotes violence or actions that are threatening to any other person, or which depicts detailed or relished acts of extreme violence or cruelty (including animal abuse).
   • Posting material that promotes or encourages participation in illegal or harmful organisations or activities (including organized criminal activity and terrorism), or the possession, manufacturing, supply, use or sale of illegal or harmful items or substances (including explosives, fireworks, weapons and controlled drugs).
   • Posting material that is malicious, threatening, abusing or insulting, or intended to harass or cause harassment, alarm or distress to another individual, including trolling, bullying, blackmailing, doxing, racial slurs, or hate mongering.
   • Posting material that promotes, encourages, or provides instructions for self-harm, suicide, or eating disorders.
   • Stalking other players.
   • Posting personal or account information (e.g., addresses, email addresses, phone numbers, web pages, social media handles, or other personal information) of another person without consent.
   • Posting material that has nothing to do with the games (e.g. discussing politics or real-world controversial events in the game).
   • Posting material that is objectionable on the grounds of public interest, public morality, public order, public security, or national harmony, or otherwise prohibited by law.
   • Advertising, soliciting, or otherwise transmitting any commercial advertisement, including gift codes or promotion, or unsolicited repetitive messages (spamming).

3. Cheating, Scamming and Spamming.

   • Botting, accessing or tampering with GameSpark computer systems.
   • Hacking or otherwise circumventing any security measure implemented by GameSpark.
   • Cheating, manipulating or circumventing game policies, game rules or game systems, such as
     • applying for refund maliciously or take advantage of rules of third-party platforms for unjust enrichment.
     • taking advantage of the price differential of Virtual Items to make profit by buying and/or selling Virtual items from/in different territories.
   • Sending any unsolicited or unauthorized advertising, promotional materials, e-mail, junk mail, spam, chain letters or other form of solicitation to other players or GameSpark accounts.
   • Obtaining or attempting to obtain passwords or other private information from other players, including but not limited to, personally identifiable information or financial information.
   • Developing, distributing, using, encouraging advancement or publicly informing other members of cheats, automation software, bots, hacks, mods or any other unauthorized third-party software or applications.
   • Using bots, hacks, mods, or exploiting game system bugs or malfunctions in GameSpark game systems to obtain Virtual Items or other benefits or advantages unfairly.
   • Scamming or encouraging scamming of other players or GameSpark.
   • Transferring, trading or selling Virtual Items or accounts.
   • Fraudulently obtaining or acquiring Virtual Items, accounts or other products or services.
   • Using our Services to build a service or game that may compete with our Services or assist another person in building a service or game that would compete with our Services.

The foregoing list is intended to provide examples of behavior that falls outside of GameSpark community standards. This is not intended to be an exhaustive list, and we refer you to our Terms of Service for further information and guidelines.

Such improper behavior interferes with the ability of other players to enjoy our games. Please note that if we suspect that a player is involved in any improper activity, we reserve our rights (at our sole discretion) to remove improper contents, temporarily or permanently prevent the player from interacting with others in the games, temporarily or permanently suspend the player account and/or prohibit the player from using our service until an investigation has been fully conducted and resolved, depending on the severity of the infraction.

If a player is involved in any improper activity, we reserve our rights (at our sole discretion) to deduct any improperly gained Virtual Items from the player account; remove improper contents; temporarily or permanently prevent the player from interacting with others in the games, temporarily or permanently suspend the player account; terminate the player account; and/or prohibit the player from using our service, depending on the severity of the infraction.

If we are requested or ordered to do so by governmental or law enforcement authorities, we may also, depending on the nature of the material that you post and our obligations under applicable laws, require you to post correction notices, disable access to your posted material by other users, stop delivery of your posted material to particular users, restrict your player account from interacting with other players, or remove your posted material.
